In Greene County district court a judgment was entered Aug. 15 against Craig Darwin Presley, 55, of Jefferson after he changed his plea to guilty to a charge of driving while license barred. He was fined $1,000 with a $350 surcharge, a $10 surcharge for drug abuse resistance education, and restitution for his court appointed attorney to be determined. Court costs were $100. Clay Thomas Paulson, 20, of Grand Junction was sentenced to two years in prison after he pleaded guilty to criminal mischief- third degree. The prison term was suspended and he was placed on probation for two years. Paulson was fined $625 with a $218.75 surcharge; both were suspended. Paulson must pay a $125 law enforcement initiative (LEI) surcharge and restitution for his court appointed attorney to be determined. Paulson was initially charged with burglary- third degree and criminal mischief- first degree. Court costs were $121. A companion case in magistrate court in which Paulson was charged with theft- fifth degree was dismissed. (Sentencing: Kester)
Cases were dismissed Aug. 17 against Gilbert James Montgomery, 60, of Grand Junction and Tammy Ann Tolsdorf, 40, of Grand Junction on charges of possession of methamphetamine- third or subsequent offense after Judge Kester sustained a motion to suppress the evidence in the case. The defense attorneys in the two cases joined in the motion.
The motion to suppress the evidence was based on an incorrect address listed in a search warrant for an apartment located at 307 N. Wilson in Jefferson. The warrant listed Apartment A, based on an assumption by the investigating Jefferson police officer and information provided to him by another JPD officer. In fact, the apartment that was searched and in which the methamphetamine was found was an unlabeled apartment on the first floor, while Apartment A is on the second floor.
Judge Kester ruled that the evidence and statements obtained as a result of the seizure of those items were illegally obtained and not admissible as evidence.
Jessica Lynn Waddell, 35, of Jefferson was also charged with possession of methamphetamine- third offense based on evidence obtained in that same search. That case was also dismissed. (Dismissals: Kester)
Craig A. Kinsey, 46, of Jefferson was granted a deferred judgment Aug. 12 after changing his plea to guilty to a charge of possession of methamphetamine. He was placed on informal probation for one year, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Kinsey must pay a civil penalty of $315, a LEI surcharge of $125, restitution for his court appointed attorney to be determined, and $150 court costs. (Sentencing: Kester)
Persons pleaded not guilty at arraignments as follows: Jerimy J. Godwin, 38, of Bouton, forgery; Christin Charles Smith, 32, of Woodward, domestic abuse assault- second offense; Kimberly Marie Smith, 43, of Jefferson, burglary- third degree (motor vehicle) and attempted burglary- third degree (motor vehicle), two counts; Christina L. Owens, 30, of Jefferson, operate vehicle without owner’s consent; and Kevin Armando Montoya, 19, of Jefferson, operating while intoxicated- first offense. A trial date was set for Sept. 27 for Owens, and for Nov. 1 in all other cases.
Cases were initiated in district court as follows: Chelsea Suzette flack, 20, of Jefferson, possession of fictitious license/ID; Troy Angelo McGee, 47, of Fort Dodge, eluding while participating in felony, possession of marijuana- third or subsequent offense, and possession of methamphetamine; and Brenda J. Kennedy, 44, of Grand Junction, unlawful possession of prescription drug (two counts), unlawful manufacture/deliver/possess marijuana with intent to deliver, less than 50 kg, and unlawful manufacture/deliver/possess methamphetamine with intent to deliver.
